Introduction

• Welcome to CASE Sankalp 2.0 (“app” or “Application” or “App”), an app being offered by Case New Holland Construction Equipment (India) Private Limited (hereinafter referred to as the “Company” or “We” or “we” or “us”) for the engagement of mechanics, authorized DSAs, part sellers, operators, agents, authorised dealers or any other user (hereinafter referred to as “Key Associates” or “You” or “you”), who wishes and willing to purchase the products of the Company.
• We value your privacy and are committed to protecting your personal information. This Privacy Policy and Terms of Usage explains how we collect, use, and share your information when you use our application, in addition to the objective and conditions pertaining to the usage of the app and the services being offered by us via app.

Purpose of CASE Sankalp 2.0

• To provide ease of convenience, to enable the Key Associates to avail the products of the Company either for themselves or for any other interested party by referring them the app and or by providing their name and contact details and such other information as sought in the app, who desires to purchase the products of the Company.

How to use app

• Eligibility: In case of natural person, you must be at least 18 years old to use our app. In case of person other than natural person, you must have appropriate approvals and consents to use the app and/or create the User Id and account in the name or for and on behalf of such person.
• User id and account:
  • To use the services of the app, Key Associates have to register themselves in the app by providing the certain details such as name, email address, phone number, bank account details and other information, to create a unique user id (“User Id”).
  • Upon submission of the information and subject to KYC, the User Id will be created, which Key Associates shall be able to use to login the app. Key Associates shall follow the instruction provided in the app to use and avail the services of the app.
  • You are responsible for maintaining the confidentiality of your account information.

Referral program

• The app also provides the feature of referral program. Under the referral program, registered Key Associates may refer the app and the products being offered by us to any prospective or willing purchaser of the products. In order to use this feature, please follow the instruction provided in the app. You must provide accurate information about the person you refer. Once the information such as name and contact details of the referred person is received, the same shall be validated by the Company and if the details of such referred person is already with us in our records, then such referral shall not be considered for the purpose of the referral program and accordingly, no reward points shall be provided for the same, even if such referral is materialized.
• Only the registered Key Associates shall be eligible to participate in the reward program as mentioned above. In other words, in order to stand eligible for the reward points basis the successful conversion of referral, the user of the app shall be a registered key Associate. If the user is not a Key Associate, then he/she/it shall not be eligible to participate in the referral program and thus, shall stand disqualified and consequently, no claims in this regard shall be entertained by the Company.
• Upon each referral being converted into a definite purchaser who purchases the products, you shall stand eligible to the reward points, as decided and allocated by the Company. Each reward point shall be equivalent to Rs. 1 (Rupees One Only) or such other value, as may be amended from time to time. The rewards points may be redeemed either by:
  • Doing money transfer via net banking method or such other available payment methods as may be provided in the app; or
  • providing e-vouchers of amazon or flipkart or any other e-voucher; or
  • Issuing discount on its products commensurating with the reward points, provided only if such purchase is made from Company’s authorised dealers; or
  • Such other methods as may be provided by the Company from time to time.
  Please note that the redemption of reward points through any of the aforesaid methods shall be subject to the availability and discretion of the Company. Further, (i) any redemption of reward points upto the value of Rs. 500 shall be carried via bank transfer; and (ii) redemption over and above the value of Rs. 500 shall be carried via any of the payment methods as mentioned above, as per the discretion of the Company.
• Sales team of the concerned branch office of the Company shall verify/approve/disapprove engagement of Key Associate and their points.
• Rewards points or benefits as accrued from or under the referral program shall be non-transferrable.
• The Company is the sole authority to amend/change/modify the nature and contents of the referral program without prior notice and shall have the discretion to terminate the referral program or extend the same. No claims/questions shall be entertained by the Company in this regard.
• The Company would have the right to verify/reject/disallow any claim in respect of the referral program including eligibility conditions. By participating in the program, the Key Associate fully and unconditionally agrees to accept the Privacy Policy and Terms of Usage as available under this program as well as the decisions of the Company, which are final and binding in all matters in relation to the referral program.
• The reward points may be different for different branches. The reward points may be updated from time to time and participants need to verify the same before redemption. To redeem the reward points, participants are required to follow directives without which the Company is not liable to fulfil the obligation of the specified points or vouchers or promo conditions.
• The program is operated in particular branches of Company as applicable from time to time.
• The rewards points cannot to be exchanged for any other scheme/offer which is being run by the Company during the relevant time.

Information We Collect

• Personal Information: When you register, we collect your name, email address, phone number, and other information.
• Referral Information: If you refer someone, we collect their name, email address, and any other details you provide.
• Usage Data and consent: We collect information about how you use the app, including your interactions, preferences, and transaction history. By using the app or accepting the present Privacy Policy and Terms of Usage, you hereby provides your unequivocal and unconditional consent to: (i) the Privacy Policy and Terms of Usage and submit yourself to be bound by the same in accordance with the terms as provided herein; and (ii) allow us to use and/or process the information and data (personal or otherwise) supplied or shared by you, while using the app, in accordance with the applicable laws including data privacy and digital personal data protection laws.

How We Use Your Information

• To Provide Services: We use your information to process transactions, manage your account, and provide customer support.
• To Improve Our Services: We analyze usage data to improve our app and develop new features.
• For Marketing: With your consent, we may send you promotional materials and offers.

Limitation of liability

• By accepting the Privacy Policy and Terms of Usage of the app, you hereby, agrees that the app is being used by you out of your own free will and volition after reading the contents of the present terms. We are not liable for any direct or indirect, incidental, or consequential damages arising from your use of the app.

Security

• We implement appropriate security measures to protect your information from unauthorized access, alteration, or disclosure, following the best practices in accordance with the applicable security laws. We shall not be liable for any misuse of your information, which occurs due to omission or oversight committed or occurred arising out of your own negligence and/or on account of default from your end.

Changes to this Policy

• We may update this Privacy Policy and Terms of Usage from time to time, as we may deem fit or if required pursuant to any change or amendment or implementation of or in the applicable laws. We will notify you of any changes by posting the new policy on our app.

Applicable law

• The Key Associates shall at all times act or adhere to the Privacy Policy and Terms of Usage in the manner and guidelines as provided herein. If Key Associates are found to be in breach of the Privacy Law and Terms, then we shall have the right to forfeit the reward points. Key Associates shall utilize the proceeds of the redeemed points in the manner which is compliant with applicable law. Key Associates shall keep us full protected and indemnified against any unauthorized or prohibited use of proceeds of the redeemed points under the applicable laws.
• The proceeds in lieu of reward points or their redemption in terms of any of the methods as provided herein, shall at all times be subject to compliance with applicable laws including extant regulations notified by Reserve Bank of India. In case, the proceeds to be made available to the Key Associates, subject to the terms contained herein, consequent upon the conversion or redemption of the reward points, are found to be prohibited or in violation of any applicable laws then such benefits/proceeds shall not be provided to the Key Associates and accordingly, we shall not be liable for the same towards the Key Associates and you agree that no claims in this regard shall be made by you in such events.

Disputes

• Any dispute or difference pertaining to any matter arising out of or in connection with the Privacy Policy and Terms of Usage shall be subject to the exclusive jurisdiction of courts of New Delhi. By accepting the Privacy Policy and Terms of Usage, Key Associates hereby submits itself/himself/herself to the exclusive jurisdiction of New Delhi.
